1. Deposit/Balance Due. All correspondence will be
sent to applicant named at the address specified on the booking form. The
booking is not accepted until you receive an acknowledgment from our office.
The applicant must pay £100 ($150) per week deposit on completion of the
booking form. The balance including £100 ($150) security deposit
(refundable) must be paid 8 weeks prior to the date of departure.
2. Period of Rental.
The rental period commences at
4:00 pm (EST) on the day of arrival. The villa must be vacated by 10:00 am
on the day of departure.
3. Liability. Although every effort is made to ensure
that the villa is in perfect order for your visit we cannot accept liability
for any third party claim, accident damage, or loss to you, your property or
for any medical expenses however incurred.
You are advised to take out your own travel and medical
insurance.
4. Cancellation.
In the event that you cancel your
booking for whatever reason the following cancellation charges will apply:
More than 8 weeks - The deposit
Between 6 and 8 weeks - 50% of the total rental costs
Between 4 and 6 weeks - 75% of the total rental costs
Less than 4 weeks - 100% of the rental costs
5. Keys. There are two ways to obtain keys to
our Florida
villa. Either the directions to the villa, keys or door code will be
forwarded to the applicant named at the address specified on the booking
form 2 weeks (approx.) before departure providing the final payment has been
received. Or, the keys will be at the villa inside a lock box. You
will be given a code with directions on how to get the keys from our
Management Company.
6. Booking. The signing of the booking form confirms the
acceptance of the terms and conditions set out below and shall be
binding on the persons intending to occupy the premises whether or not
such persons have signed the booking form. Each booking will be
confirmed by the Company as soon as reasonably possible after receipt of
the signed booking form, and the appropriate deposit. If the booking is
made direct with the Company, the Company will send all correspondence
to the person who signed the booking form at the address shown on the
form. If the booking is made via a travel agent, the Company will send
all correspondence to the travel agent.
7. Additional Security Deposit.
In addition to the reservation
deposit, a security deposit of £100.00/$150.00 for lettings up to two
weeks plus (£50.00/$80.00) for each additional week or part thereof is
payable to cover breakages or damage to the premises and/or contents,
telephone bills, cleaning costs other than those normally incurred in
connection with the occupation of the premises, but not including for
example, the cleaning of the carpets, upholstery, etc. This deposit is
returnable, subject to deductions to cover the expenses mentioned above
within 60 days of vacation of the premises.
8. Unavoidable Changes. The Company reserves the right in any
circumstances to cancel the booking and in this event the Company will
return all sums (but without interest or compensation) or (at the option
of the Clients and subject to availability) the Company will offer
alternative premises of comparable standard. In the event of a major
change to the booking being necessary, the Company will inform the
Client as soon as reasonably possible, and if the Client does not wish
to accept the booking on this basis the Company will cancel and booking
and return all sums (but without interest or compensation).
9. Force Majeurs. The Company accepts no responsibility or
liability whatsoever for any loss or damage or alteration to the terms
of the booking caused by events beyond the Company's control including
(but without prejudice to the generality of the foregoing) war, civil
commotion, flight delays or cancellations, adverse weather conditions,
fire, flood or industrial dispute.
10. Complaints. Should a problem arise relating to the
premises the Client should contact the Company's representative. Details
are enclosed in the information folder which will be found on arrival at
the premises.
11. Availability. The premises will be available for
occupation from 4pm (EST) on the first day of the rental period and must
be vacated by 10am (EST) on the day of departure. Client will obtain
keys to the premises via a lock box. The code will be provided to
the client prior to their arrival.
12. Liability. The Company and the owners of the premises
accept no responsibility whatsoever for person injury, accidents, loss
or damage to persons or personal effects, however caused.
13. Alterations. For alterations requested by the Client
within 8 weeks of the day of departure, an administration fee of £20/$30
per booking will be charged.
14. Safety & Security. The Company reserved the right to enter
the premises at any time for whatever reason.
15. Travel Insurance. The Client must arrange insurance cover
either through the Company's holiday insurance scheme or by arranging a
comparable policy giving the same or greater cover under all sections.
If the Company's scheme is used the premium is payable at the time of
booking as shown on the booking form. If alternative cover is arranged
the policy must be produced to the Company no later than 8 weeks prior
to the date of departure.
16. Documentation. All passports, visas and health certificate
requirements are the Client's responsibility. The Company accepts no
responsibility for any delay or expense incurred through any
irregularity in such documents.
17. Price Guarantee. Except as a hereinafter mentioned, the
price of renting the premises is fully guaranteed and no surcharges will
be added to the cost shown on the booking form.
Any increases in taxes imposed directly or indirectly by the UK or US
Governments will be passed on to the Client provided that if such
increases do not exceed 2% of the total cost shown on the booking form
these will be paid by the Company.
18. Brochure Descriptions. All brochure descriptions are mode
in good faith and every care is taken to ensure their accuracy, but no
liability will be accepted in the event of any error or misprints.
19. Contract. This contract is governed and shall be
interpreted in accordance with American law and the parties hereto shall
both submit to the jurisdiction of the American courts.
